A change of registration may cause you to lose your Community Residency."},"content":{"rendered":"<p>One of the fundamental requirements for maintaining the <strong>Tarjeta de Familiar de Ciudadano de la Uni\u00f3n Europea (EU Family Card)<\/strong> in Spain is the <strong>effective cohabitation with the EU or Spanish citizen<\/strong>. Such cohabitation is mainly accredited through the <strong>registration<\/strong>so that a <strong>change of registration without notifying the foreigners' registration office<\/strong> can jeopardise residency and lead to the <strong>loss of the Community card<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">When can the Community Card be lost?<\/h2>\n\n\n\n<p>\ud83d\udd39<strong> Change of registration and break in cohabitation<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <strong>community residence<\/strong> is based on coexistence with the community citizen.<\/li>\n\n\n\n<li>If one of the family members changes his or her <strong>registration without justification<\/strong>is interpreted as <strong>breakdown of cohabitation<\/strong>which may lead to the termination of the card.<\/li>\n\n\n\n<li>To avoid this, it is important to <strong>notifying a change of address<\/strong> to foreigners.<\/li>\n<\/ul>\n\n\n\n<p>\ud83d\udd39<strong> Breaking the link with the EU citizen<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If there is <strong>divorce, separation or dissolution of the registered partnership<\/strong>Community residence may be lost.<\/li>\n\n\n\n<li><strong>Exception<\/strong>: The card may be kept if the marriage or relationship has lasted at least <strong>three years<\/strong>, <strong>one of them in Spain<\/strong>before the separation.<\/li>\n\n\n\n<li>If these requirements are not met, it will be necessary to modify the Community card to a <strong>residence under the general scheme<\/strong> (employed, self-employed or settled).<\/li>\n<\/ul>\n\n\n\n<p>\ud83d\udd39<strong> Insufficient financial means<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Throughout the validity of the card it is compulsory to provide proof of <strong>sufficient financial resources<\/strong>.<\/li>\n\n\n\n<li>If the EU citizen no longer complies with this requirement, the EU card may be revoked.<\/li>\n<\/ul>\n\n\n\n<p>\ud83d\udd39<strong> Loss of \"dependant\" status<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Children over 21 years of age<\/strong> y <strong>ascendants<\/strong> must demonstrate <strong>economic dependence<\/strong> of the EU citizen.<\/li>\n\n\n\n<li>If they start working on a regular basis and get <strong>own resources<\/strong>may lose the right to the Community card.<\/li>\n<\/ul>\n\n\n\n<p>\ud83d\udd39<strong> Criminal or police record<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Having a criminal record can affect the <strong>concession, renewal or maintenance<\/strong> of the Community card.<\/li>\n\n\n\n<li>The following would be an asset <strong>seriousness of the offence<\/strong> and its impact on public order or the security of the country.<\/li>\n<\/ul>\n\n\n\n<p>\ud83d\udd39<strong> Excessive absences outside Spain<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It is not possible to exceed the <strong>6 months out of Spain in one year<\/strong>.<\/li>\n\n\n\n<li>In some cases, it can be extended up to <strong>one year<\/strong> for justified reasons (training, illness, pregnancy, etc.).<\/li>\n\n\n\n<li>If this limit is exceeded without just cause, Community residence will be lost.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">How can I avoid losing my Community Card?<\/h2>\n\n\n\n<p>\u2714 Keep the registration with the EU citizen up to date.<br>\u2714 Notify any change of address to the foreigners' office to avoid problems.<br>\u2714 Ensure that the financial means necessary for the residence are maintained.<br>\u2714 Not to exceed the allowed time of absence outside Spain.<br>In the event of termination of the relationship, check whether the conditions for keeping the card are met.<\/p>\n\n\n\n<p><strong>If you have doubts about your EU residency or you need advice to avoid losing your card, at Echeverr\u00eda Farriols Abogados &amp; Asociados we will accompany you throughout the process. <\/strong><\/p>","protected":false},"excerpt":{"rendered":"<p>One of the fundamental requirements for maintaining the European Union (EU) Citizen Family Card in Spain is effective cohabitation with the EU or Spanish citizen.
