SECOND CHANCE ROOTS

WHAT IS IT?

New pathway for foreign nationals who lost their residence and want it back.

REQUIREMENTS

  • Having been holder of a residence permit in the two years preceding the application.
  • The authorisation it must not have been granted in exceptional circumstances.
  • Failure to renew the authorisation due to reasons other than reasons of public order, public security or public health.
  • It may be requested if there is a judgment of refusal, dismissal or acquittal of the penalty.

BENEFITS

  • Facilitates the legal reintegration of people who have lost their residence.
  • Aligned with the reform of the Aliens Regulation of 20 May.

SOCIO-OCCUPATIONAL ROOTS

WHAT IS IT?

It is granted to foreigners who have worked in Spain without legal authorisation and can prove their employment relationship.

REQUIREMENTS

  • Minimum residence of two years in Spain.
  • Submit one or more employment contracts that guarantee at least the Minimum Interprofessional Wage (SMI) or the salary set out in the applicable collective agreement.
  • The total working time may not be less than 20 hours per week on a global basis.

SPECIAL CASES WHERE SEVERAL CONTRACTS CANNOT BE PROVIDED

  1. For seasonal or seasonal workIf you have a contract with a different employer, you may have several contracts with different employers.
  2. For simultaneous partial activities with more than one employerIn the case of a contract of employment, the submission of several contracts in different occupations shall be admissible.

IMPORTANT

  • This does not include self-employment or the option of starting one's own business.

BENEFITS

  • Greater flexibility in work requirements, facilitating regularisation.

SOCIO-FORMATIVE ROOTS

WHAT IS IT?

It grants a residence authorisation to foreign nationals who training to improve their employability in Spain.

REQUIREMENTS

  • Be enrolled or studying: 
    • Vocational training referred to in Articles 52.1.b) and 52.1.e) of the Aliens Regulation.
    • Level 1 training.
    • Compulsory courses within adult education in face-to-face mode.

APPLICATION DEADLINE

  • If the number plate has a official deadlinethe application for a residence permit must be submitted within two months before the start of that period.
  • The proof of registration must be accredited to the Aliens Office in a maximum period of three months after notification of the granting of authorisation.

TERMINATION OF AUTHORISATION

  • If there is no proof of registration within the required deadlinethe authorisation shall be automatically extinguished.

EXTENSION

  • It will be possible to to extend once only for a further period of 12 months if the training lasts more than one year or exceeds the period of validity of the first authorisation granted.

FAMILY ROOTS

WHAT IS IT?

It is granted to foreigners with family ties to citizens of the European Union. European Union, European Economic Area or Switzerland.

REQUIREMENTS

  • Being a parent or guardian of a minor who is a national of the EU, EEA or Switzerland, and provide proof: 
    • Residence in Spanish territory.
    • To be in charge of the child.
    • Cohabit with the child or be up to date with parental obligations.
  • Being a support person for a person with a disabilitywho is a national of the EU, EEA or Switzerland, for the exercise of his or her legal capacity.
