The Official State Gazette (BOE) has published the resolution approving urgent measures for the extension and renewal of residence and work authorisations for foreigners affected by the DANA between 28 October and 4 November 2024. These measures aim to avoiding supervening irregularity and ensure the legal certainty of migrants and employers.
Main measures taken
1. Extension and automatic renewal of permits
✔ Residence and work authorisations which expire between 30 July 2024 and 1 April 2025except in cases of public order or public health.
✔ Relaxation of requirements for renewals of permits affected by the DANA.
2. Relaxation of requirements for pending applications
✔ The applications submitted shall be favourably approved. before 4 November 2024even if those affected no longer meet some of the requirements due to the disaster.
3. Residence in exceptional circumstances
✔ One 1-year residency for foreigners without prior authorisation who lived in the municipalities concerned, with the right to working throughout Spain.
✔ Relatives of fatalities of the DANA will receive an authorisation from 5 years.
4. Work permits affected by Social Security registration
✔ Social Security affiliation requirements are relaxed to prevent workers from losing their residence and employment authorisation.
