Summary of the novelties of the Aliens Regulation that will enter into force on 20 May 2025

The Council of Ministers has approved the new Aliens Regulationa key reform that seeks to adapting the regulations to the current migratory reality, meeting the needs of the labour market and improving the integration of migrants in Spain. This change also ensures compliance with European law, transposing pending directives and improving legal certainty.

The reform introduces improvements in visas, roots, work, study and family reunification permitsThe aim is to facilitate the regularisation of migrants, combat fraud and promote social and labour inclusion.

🔹 Main new features of the Aliens Regulation

1️ Changes to visas

✔ A specific title for visaswhich simplifies requirements and procedures.
All initial authorisations shall be for 1 year and renewals for 4 years.The Commission has also been able to avoid any irregularities that may arise.
Facilitating changes of residenceIt will not be necessary to leave Spain in order to change from temporary to long-term residence.
Jobseeker's visa extended to 12 months (previously 3 months), allowing migrants to find work in their sector.

2 Creation of a new "Arraigo" and relaxation of requirements

Spain becomes the only EU country with a specific figure of migratory regularization by means of rootsnow with five modalities:

Social Roots
Socio-occupational roots
Family roots
Socio-formative rootedness (upgraded, with the possibility of exceptional renewal)
Second Chance Arraigo (new, for those who have had a residency in the last two years and did not renew it for non-penalisable reasons)

🟢 The number of required years of residence is reduced from 3 to 2 years..
🟢 Requirements are made more flexible and work is allowed from the outsetboth as an employee and as a self-employed person.
🟢 All authorisations will be for 1 year, except for the family integration permit, which will be for 5 years.

📌 It is estimated that 300,000 people will be regularised each year with these changes.

3 More job opportunities and stability for migrants

✔ Most authorisations will allow you to work from day one, without the need for additional formalities.
Students will be able to work up to 30 hours per week, which will facilitate their integration into the labour market.
A special permit is created for temporary and seasonal work, ensuring better working conditions and protection against abuse.
✔ Employers will have more information and flexibility in recruiting migrants.

4️ What's new in the Residence for Studies and Training

✔ The duration of the authorisation to stay for study purposes shall be the same as the duration of the training.
Ease of transition from student to worker with a streamlined process.
✔ Better control over study centres to avoid fraud in the issuing of certificates.

5️ Extension of Family Reunification and New Authorisations for Relatives of Spaniards

The age of children eligible for reunification is extended to 26 years (previously 21).
✔ Unregistered partners may be reunited, provided that a stable relationship can be demonstrated.
Reunification is extended to children and parents of victims of trafficking, sexual or gender-based violence.

It is estimated that thousands of families will be able to benefit from this measure, especially those in which one of the members has recently obtained Spanish nationality.

It will facilitate the integration of migrants into the labour market and society.
✔ It will increase the regularisation of people already living in Spain.
It will simplify and streamline procedures, reducing the bureaucratic burden.
It will allow companies to recruit workers with greater legal certainty.
