New Aliens Regulation in force as of 20 May 2025

A key reform for the regularisation, residency and integration of foreigners in Spain

On 20 May 2025, the new Aliens Regulation, approved by Royal Decree 1155/2024, came into force. This long-awaited reform represents the most profound change in the field of foreigners in recent years and responds to the need to adapt the regulations to Spain's social, labour and demographic challenges.

The new regulation introduces important improvements in the procedures for residence, family reunification and access to the labour market, with special attention to the inclusion of vulnerable groups and the promotion of training as a means of integration.

Major developments already underway:

🔹 New types of rootsFive types of residence for exceptional circumstances are consolidated: social roots, family roots, socio-occupational roots, socio-training roots and the new second-chance roots, aimed at people who lost their previous permit.

🔹 Reduction of deadlinesThe length of stay in Spain required to apply for some arraigos is reduced from three to two years, which facilitates the regularisation of many foreigners.

🔹 Improvements for foreign studentsThey can now work up to 30 hours a week, even if they do part of their studies online. In addition, their family members can apply to stay in Spain.

🔹 More flexible family reunificationThe age of children eligible for reunification is extended to 26 years and the possibility of reuniting unregistered partners, as well as family members of victims of gender-based violence, sexual violence or trafficking, is recognised.

🔹 Residence for Spanish family membersA specific permit is created to facilitate regularisation and provide greater stability.

🔹 Ease of changing licences without leaving Spain: In many cases, it will no longer be necessary to return to the country of origin to amend an authorisation.

This reform strengthens legal certainty, simplifies administrative procedures and expands the rights and possibilities for thousands of foreigners who have made Spain their home.
